Supreme Court gives ammo to GOP on Sotomayor’s nomination
The Supreme Court has ruled 5-4 for white firefighters in New Haven, Conn., who the Court decided were qualified for promotions based on a test they took and passed. The city had thrown out the results because black firefighters did not pass and they feared a discrimination lawsuit.

Supreme Court Nominee Sonia Sotomayor was one of three judges who had previously ruled again the firefighters in a lower court. This overturning of the ruling has fired up the GOP and given ammunition to their argument that Sotomayor is racist and out of touch. Not so fast says the Daily Kos.

On a purely factual basis, this makes no sense, but since when have facts had to do with politics?

From the standpoint of single, sound bite image, it makes sense, but I don't think it'll stick. I suspect the GOP will come off looking rabid and single minded, while their base will give them props and the politicans will feel as though they're doing something.
Advocates of "reverse discrimination" arguments will have a field day with these things no matter the facts, logic, and specific circumstances of each case.

Personally this one confuses me pretty terribly. I need to read more about it.
Yeah, there's a lot of details and nuisance beyond the WHITE and BLACK and DISCRIMINATION. It's more like the city believed it was screwed no matter what, so it went for the least painful decision.
Which has a certain irony to it in the end.
SCOTUS blog notes that the 5-4 decision Sotomayor isn't that controversial, especially since she's replacing Souter, who voted with the minority.
Yeah the connection to her really isn't a big deal, but the headlines have mostly suggested otherwise.
